Not Legal



If the caption of the photographer is correct, then in the United States this is illegal. If they are Police SWAT (Special Weapons and Tactics) or the National Guard then it is OK. However, calling out the National Guard for a minor domestic disturbance is at least troubling.

  1. This newspaper is from Canada so maybe they don't know. However, they do look like US military to me too. There has to be something wrong with news story, it can't be correct.

    You are reminicing about the Posse Comitatus act which does not allow deployment of active US military units on American soil. However, if you do some research on the 1807 Insurrection Act which was recently modified by congress you will see the president has been given broad discretion to deploy US military (not the National Guard-- we are talking about the REAL Military) in active duty on the streets of the US for just about any reason.
    Such deployments will endow the US military with police power with automatic implementation of martial law.
    This has not been tested in the US Courts and probably would be unconstitutional from a states rights perspective. However, when it happens, I don't think any court papers will be being filed. Do You?
